These terms apply when you buy from puiwafarms.com, which is operated by Pūʻiwa Farms Hawaiʻi. By placing an order you agree to them.
Who can order
You are responsible for knowing whether our products may lawfully be sold to and received at your address. We currently ship within the United States only.
Our products
We sell fresh frozen Hawaiian ʻawa (kava) root, grown on our farm on the Hāmākua coast. ʻAwa is an agricultural product. Colour, aroma, potency and the exact cultivar vary with the harvest, the weather and the age of the plant, and photographs on this site are illustrative.
Cultivars are chosen at harvest and cannot be requested. We ship whichever of our thirteen cultivars are mature and ready. Every bag is labelled with the cultivar inside it.
Prices and payment
Prices are in US dollars and may change without notice; the price that applies is the one shown when you place your order. Payment is taken at checkout. If we cannot fulfil an order we will cancel it and refund you in full.
We may refuse or cancel any order — including one already placed — if a product is mispriced or unavailable, or if we suspect fraud.
Shipping
- Orders ship Mondays and Tuesdays only. Frozen root cannot sit in transit over a weekend.
- We cannot ship to PO boxes. Frozen freight needs a street address.
- We ship within the United States only.
- Delivery estimates are estimates. Once a parcel is with the carrier its progress is outside our control.
- Risk of loss passes to you on delivery to the address you gave us.
Please arrange for someone to receive the parcel, or to move it to a freezer promptly. We cannot be responsible for product that thaws after a successful delivery.
Returns and refunds
ʻAwa is perishable, so we cannot accept returns of opened or thawed product. We will put things right if we got them wrong:
- If your order arrives damaged, thawed on arrival, or is not what you ordered, email info@puiwafarms.com within 24 hours of delivery with photographs and your order number.
- We will replace it or refund it, whichever you prefer.
- If a delivery fails because the address was wrong or nobody was able to receive it, we cannot refund the product or the shipping.
Health and intended use
These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure or prevent any disease.
Nothing on this site is medical advice. ʻAwa is a traditional beverage, not a medicine.
Do not use ʻawa if you are pregnant or nursing, if you have liver problems, or if you take prescription medication, without speaking to a doctor first. Do not combine it with alcohol. Do not drive or operate machinery after drinking it. Stop and seek medical advice if you feel unwell.
Your account
Keep your password to yourself; you are responsible for activity under your account. Tell us promptly if you think someone else has access to it.
Acceptable use
Do not use this site to break the law, to interfere with how it works, to scrape it at a scale that affects other people, or to resell our products as your own without a written agreement with us.
Our content
The text, photographs, logo and design on this site belong to Pūʻiwa Farms Hawaiʻi and may not be copied or reused commercially without our permission.
Limitation of liability
To the fullest extent the law allows, our liability for any claim relating to an order is limited to what you paid for that order. We are not liable for indirect or consequential loss. Nothing here limits liability that cannot lawfully be limited.
Governing law
These terms are governed by the laws of the State of Hawaiʻi, and any dispute will be heard in the courts of Hawaiʻi County.
Changes
We may update these terms; the date at the top shows when. The terms that apply to your order are the ones published when you placed it.
